The expression "common property resource" has frequently been used within fishery economics to refer to institutional situations of "res nullis" or "public property". The fundamental objective of this paper is to clarify this conceptual confusion since, in our opinion, feasible fishing model solutions will be different depending on different property regimes. In this paper we start by explaining three institutional fishery scenarios, we continue with a study of the fishing solutions and conclude with a comparison of the results and their regulatory implications.
